Swiss non-profit use with OA publishing
Data Access Policy: 1. Definitions 1.1. Data Submitter” refers to researchers or research institutions who are depositing a Dataset with Swiss FEGA. The Data Submitter entrusts a Data Access Committee (DAC) with the authority to decide on granting access to the Dataset. 1.2. “Data Access Committee (DAC)” is a committee mandated by the Data Submitter to decide whether to grant or deny access to the Dataset submitted on the Swiss FEGA. The DAC makes its decisions based on the DAC Policy applicable to the Dataset. 1.3. “Dataset” refers to any and all human genetic data, biometric data or other data concerning health obtained from the Data Submitter including associated metadata regarding the Data Subjects. For the avoidance of doubt, Dataset does not include any samples or biological materials. 1.4. “Data Subject” refers to the natural person whose personal data has been used to generate Dataset. 1.5. “Project” refers to the research project for which the Data Requester has requested access to the Dataset. 1.6. “Data Requester” refers to the collaborator of the Data Requester Institution duly authorized to act on its behalf whose application for access to the Dataset has been approved by the DAC. 1.7. “Data Requester Institution” refers to the organization with which the Data Requester is employed, affiliated or enrolled. 2. Purpose of the Data Access Policy This DAC Policy is designed to ensure that data sharing complies with the criteria set by the Data Submitter and to guide the DAC in assessing and granting or denying data access requests. 3. Scope of the Data Access Policy This DAC Policy applies to datasets that the Data Submitter has opted to share under these terms and in accordance with applicable laws. Page 2 of 2 4. Data Access Criteria Access to the Dataset is subject to the following requirements: 4.1 Use for specific purposes only The Dataset may be used exclusively for scientific research. 4.2 No commercial use Any use for commercial gain or profit-driven activities is stricly prohibited. 4.3 Access Limitation The access to the Dataset is restricted to research institutions and non-profit organisations. 4.4 Geographic restriction Access to the Dataset is limited to Data Requesters based in Switzerland. 4.5 Publication and Open Access All publications derived from the Dataset shall be published in compliance with Open Access principles as defined in the UNESCO Recommendation on Open Science. 4.6 Acknowledgement Any publication or conference related to the dataset must include an acknowledgment for the Dataset and the Data Submitter.
